Lindsay A. G. Plantholt is a partner at Ferrara Fiorenza, PC. She works primarily with public school district and BOCES clients with respect to district policies and procedures, student-related concerns, statutory/regulatory compliance and employment and labor relations matters. Lindsay assists clients on a broad range of issues, and her practice focuses on the following:
Working with school administrators to help develop and amend policies governing students, personnel and school operations.
Providing advice and counsel for districts regarding improving security of their electronic records systems, protecting student privacy and data, and responding efficiently and effectively to potential breaches of those systems, and managing overall Education Law § 2-d and Part 121 compliance.
Ensuring compliance with requests for records under the Family Educational Rights and Privacy Act (FERPA) and the New York State Freedom of Information Law (FOIL). Lindsay also counsels districts regarding their legal obligations in the event of a breach involving electronic records systems, and the retention obligations under the LGS-1 Records Retention Schedule.
Regularly acting as a hearing officer for student disciplinary hearings. She has also represented districts in Appeals to the Commissioner regarding student disciplinary and residency issues.
Experience with student-centric matters including: determinations of student residency status or homeless status under McKinney-Vento; medication management and other health-related concerns; interscholastic athletics and extra-curricular activities; and food services and free and reduced lunch programs.
